Terms of Service

IMPORTANT — PLEASE READ CAREFULLY. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Voyage - The Itinerary App ("Voyage", "we", "us", or "our") governing your access to and use of the Voyage mobile application, website, and related services (collectively, the "Service"). By creating an account, downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

These Terms contain important provisions including a mandatory arbitration clause, class action waiver, and limitations of liability that affect your legal rights. Please read them carefully.


1. Eligibility and Acceptance

1.1 Age Requirement. You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is greater, to use the Service. By using the Service, you represent and warrant that you meet this age requirement. The Service is not intended for or directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information.

1.2 Capacity. You represent that you have the legal capacity to enter into these Terms and that all information you provide is accurate, current, and complete.

1.3 Acceptance. By creating an account, you affirmatively accept these Terms. Your continued use of the Service after any modifications constitutes your acceptance of the modified Terms.

1.4 Geographic Restrictions. The Service is operated from the United States. We make no representation that the Service is appropriate or available in other locations. Users who access the Service from outside the United States do so at their own initiative and are responsible for compliance with local laws.


2. Description of Service

2.1 General Description. Voyage is a vacation and trip planning application that provides users with tools to create itineraries, discover destinations and accommodations, optimize routes between locations, and view restaurant reservation availability. The Service uses third-party data sources and APIs to provide its features.

2.2 No Travel Agent or Booking Service. Voyage is a planning and discovery tool only. We are not a travel agent, tour operator, hotel, restaurant, transportation provider, or booking service. We do not sell, offer, or guarantee any travel products, accommodations, reservations, or services. Any bookings or reservations made by you are transactions between you and the third-party provider (e.g., Booking.com, restaurants, airlines, etc.), and Voyage is not a party to those transactions.

2.3 Service Modifications. We reserve the right to modify, suspend, or discontinue any part or all of the Service at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

2.4 Beta Features. From time to time, we may offer features that are designated as "beta", "preview", "experimental", or similar. Such features are provided "as is" and may be discontinued or modified at our sole discretion.


3. Account Registration and Security

3.1 Account Creation. To access certain features of the Service, you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information and to update such information as necessary.

3.2 Account Credentials. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

3.3 No Liability for Unauthorized Use. We are not liable for any loss or damage arising from your failure to comply with these security obligations or from unauthorized use of your account.

3.4 One Account Per Person. You may not maintain more than one account, share your account, or transfer your account to another person.

3.5 Account Termination by Us. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraud, abuse, or non-payment.

3.6 Account Deletion. You may request deletion of your account by contacting us at the address provided in Section 22. Upon deletion, your personal data will be removed in accordance with our Privacy Policy, subject to retention requirements for legal, financial, or operational purposes (including transaction records, fraud prevention, and dispute resolution).


4. Subscriptions, In-App Purchases, and Credits

4.1 Credit System. The Service operates on a credit-based system. Certain features (including but not limited to swipes in the Discover feed and route optimization) consume credits. Credits are categorized as:

Subscription pricing is displayed in the Service prior to purchase and may vary by region. Pricing is subject to change at our discretion, with advance notice for existing subscribers.

4.3 Consumable Purchases. Reserve credit packs (e.g., com.voyage.reserve5) are one-time, non-refundable consumable purchases.

4.4 Auto-Renewal. SUBSCRIPTIONS AUTOMATICALLY RENEW at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your payment method on file with Apple App Store or Google Play Store will be charged at confirmation of purchase and at each renewal. You can manage and cancel subscriptions in your device's account settings.

4.5 Payment Processing. All payments are processed exclusively by Apple Inc. (via the Apple App Store) or Google LLC (via Google Play Store). Voyage does not directly process payments and does not receive or store your payment card information. Your purchases are subject to Apple's or Google's respective terms of service and privacy policies, in addition to these Terms.

4.6 No Cash Value. Credits have no cash value, are not redeemable for cash or any other currency, are non-transferable, and may not be sold, exchanged, gifted, or used outside the Service. Credits represent a limited, revocable, non-exclusive, non-transferable license to access certain features and do not constitute property, currency, or a financial instrument.

4.7 Refund Policy.

4.8 Price Changes. We reserve the right to change subscription prices, credit amounts, and pricing structures at any time. Existing subscribers will be notified of price increases in advance and may cancel their subscription before the change takes effect.

4.9 Failed Payments and Grace Period. If a subscription renewal payment fails, your subscription may enter a grace period as determined by Apple or Google. If payment is not resolved during the grace period, your subscription will expire and access to subscription benefits will be revoked.

4.10 Promotional Offers. We may offer promotional pricing, free trials, or other incentives from time to time. Such offers are subject to additional terms and may be modified or revoked at any time.


5. Promoted Content, Sponsorships, and Affiliate Relationships

5.1 Promoted Places. The Service may display "Promoted", "Sponsored", "Featured", or similarly designated places (restaurants, accommodations, attractions, etc.) in search results, the Discover feed, or other parts of the Service. Promoted places are paid placements that appear with higher ranking than they otherwise would based on relevance or distance algorithms alone. We mark promoted content with a visible indicator (e.g., "Featured" badge).

5.2 Affiliate Relationships. Voyage participates in affiliate marketing programs, including but not limited to the Booking.com Affiliate Partner Program. When you click on accommodation listings, hotel links, or other affiliate links within the Service and subsequently complete a booking or transaction on the third-party platform, Voyage may earn a commission or referral fee at no additional cost to you.

5.3 FTC Disclosure. In accordance with the U.S. Federal Trade Commission's guidelines, we disclose that we have material connections with certain third parties through advertising, affiliate, sponsorship, and similar commercial arrangements. The presence of promoted, sponsored, or affiliate content does not constitute an endorsement, recommendation, or guarantee by Voyage of the products, services, or businesses featured.

5.4 No Influence on Independent Recommendations. Where the Service provides ratings, reviews, or rankings, the content sourced from third parties (e.g., Google Places, Booking.com guests) represents the opinions of those third parties or aggregated user opinions and is not authored or endorsed by Voyage.

5.5 Third-Party Transactions. Any transaction you enter into with a third party through an affiliate link or otherwise is solely between you and that third party. Voyage is not a party to such transactions and is not responsible for the terms, performance, fulfillment, refunds, quality, or any other aspect of any third-party product, service, or booking.


6. Third-Party Services and Data Sources

6.1 Reliance on Third Parties. The Service depends on, integrates with, and displays data from various third-party services, including but not limited to:

All third-party data displayed in the Service (including but not limited to place names, addresses, coordinates, photos, ratings, reviews, business hours, pricing, availability, amenities, and descriptions) is provided by third parties and may be inaccurate, incomplete, outdated, or unavailable. 6.3 Independent Verification. You agree to independently verify all critical information (including but not limited to business hours, addresses, pricing, availability, reservation confirmations, and travel requirements) directly with the relevant third-party provider before relying on it.

6.4 Third-Party Terms. Your use of third-party services accessed through the Service may be subject to those third parties' own terms of service and privacy policies. We encourage you to review the terms of:

6.5 Third-Party Service Failures. We are not responsible for any failure, error, downtime, rate limit, change in API behavior, or discontinuation of any third-party service. Such failures may result in degraded or unavailable functionality of the Service.


7. Location Data and Trip Information

7.1 Location Permissions. Certain features require access to your device's location. You may grant or revoke location permissions in your device settings. Revoking location permissions may impair Service functionality.

7.2 Itinerary Optimization. Route optimization features use the Google Cloud Route Optimization API. The accuracy of optimized routes depends on third-party data and algorithms beyond our control. Optimized routes are suggestions only and should not be relied upon for time-sensitive travel.

7.3 Travel Advisories and Safety. The Service does not provide travel advisories, safety warnings, visa requirements, health information, or similar guidance. You are solely responsible for researching and complying with all travel requirements, advisories, and safety considerations applicable to your destinations.

7.4 No Real-Time Navigation. The Service is not a turn-by-turn navigation tool and should not be used for active navigation while driving or operating vehicles. Use a dedicated navigation application for real-time directions.


8. User Content and Trip Data

8.1 Your Content. "User Content" means any content you create, upload, submit, or store through the Service, including but not limited to trip names, destination notes, custom configurations, and itineraries.

8.2 Ownership. You retain ownership of your User Content. We do not claim ownership of your trips, destinations, or personal annotations.

8.3 License to Voyage. By using the Service, you grant Voyage a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, create derivative works of, communicate, publish, and display your User Content solely for the purpose of operating, providing, improving, and developing the Service, including:

8.4 Anonymized Data Collection (Opt-In). With your explicit consent (provided via the Consent Screen on first use), we may collect, store, and process anonymized trip data for analytics, machine learning, product improvement, and to power features such as popular destination suggestions. Anonymized data does not include your name, email, exact trip dates, or any directly identifying information. You may withdraw consent at any time through Settings, and future trips will not be collected; however, previously collected anonymized data may continue to exist in aggregate datasets as it is not linked to you.

8.5 Trip Storage and Sync. Your trips are stored locally on your device and, if you are signed in, synced to our servers. We use Supabase as our data processor. While we implement industry-standard security practices, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8.6 No Public Sharing (Currently). As of the Last Updated date, the Service does not include public sharing or social features. Your trips are private to your account. If we introduce sharing features in the future, additional terms may apply.

8.7 Content Restrictions. You agree not to create User Content that:

8.8 Right to Remove. We reserve the right (but not the obligation) to remove any User Content from our servers at any time for any reason, including violation of these Terms.


9. Acceptable Use

10. Intellectual Property

10.1 Voyage Property. All intellectual property rights in and to the Service, including but not limited to software, code, design, graphics, text, logos, trademarks, and the "Voyage" name and brand, are owned by or licensed to Voyage and are protected by U.S. and international intellectual property laws.

10.2 Limited License to You. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

10.3 No Other Rights. No rights are granted to you other than those expressly set forth in these Terms. All rights not expressly granted are reserved by Voyage.

10.4 Third-Party Content. Content displayed in the Service that originates from third parties (e.g., Google Place photos, Booking.com listings, restaurant data) is owned by those third parties and is subject to their respective intellectual property rights.

10.5 DMCA / Copyright Complaints. If you believe content in the Service infringes your copyright, please contact us with: (a) a description of the copyrighted work; (b) the location of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (f) your signature.

10.6 Feedback. Any feedback, suggestions, or ideas you provide to us regarding the Service are non-confidential, and you grant us a perpetual, worldwide, royalty-free, transferable license to use such feedback for any purpose without compensation or attribution to you.


11. Privacy

11.1 Privacy Policy. Our collection, use, and disclosure of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11.2 Consent to Data Processing. By using the Service, you consent to the collection, processing, transfer, and storage of your information as described in our Privacy Policy, including transfer of data to the United States and other jurisdictions where our servers and service providers are located.

11.3 Your Rights. Depending on your jurisdiction, you may have certain rights regarding your personal data (e.g., access, correction, deletion, portability, objection). You may exercise these rights as described in our Privacy Policy or by contacting us.


12. DISCLAIMER OF WARRANTIES

12.1 AS-IS BASIS. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOYAGE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

12.2 NO RELIANCE. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. ANY RELIANCE ON THE SERVICE OR ITS CONTENT IS AT YOUR OWN RISK.

12.3 NO ADVICE. NOTHING IN THE SERVICE CONSTITUTES TRAVEL, MEDICAL, LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. CONSULT QUALIFIED PROFESSIONALS BEFORE MAKING TRAVEL DECISIONS.

12.4 JURISDICTION-SPECIFIC RIGHTS. Some jurisdictions do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted in your jurisdiction, the disclaimers in this Section apply to the fullest extent permitted by law.


13. LIMITATION OF LIABILITY

13.1 EXCLUSION OF DAMAGES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VOYAGE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF VOYAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13.2 AGGREGATE LIABILITY CAP. IN NO EVENT SHALL VOYAGE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF:

13.3 ESSENTIAL ELEMENT. YOU ACKNOWLEDGE THAT THE LIMITATIONS OF LIABILITY IN THIS SECTION ARE AN ESSENTIAL ELEMENT OF THE BARGAIN BETWEEN YOU AND VOYAGE AND THAT VOYAGE WOULD NOT PROVIDE THE SERVICE WITHOUT THESE LIMITATIONS.

13.4 JURISDICTION-SPECIFIC RIGHTS. Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations are not permitted in your jurisdiction, our liability is limited to the fullest extent permitted by law.


14. Indemnification

You agree to defend, indemnify, and hold harmless Voyage and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.


15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

15.1 Informal Resolution. Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us at the address in Section 22. We will attempt to resolve the dispute through good-faith negotiation within sixty (60) days.

15.2 Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in the English language. The arbitrator's decision shall be final and binding.

15.3 Class Action Waiver. YOU AND VOYAGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of class proceeding.

15.4 Jury Trial Waiver. YOU AND VOYAGE WAIVE ANY RIGHT TO A JURY TRIAL.

15.5 Exceptions. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the scope of small claims jurisdiction. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.

15.6 Opt-Out. You may opt out of the arbitration agreement by sending written notice to us at the address in Section 22 within thirty (30) days of first accepting these Terms. The notice must include your name, email address associated with the account, and a clear statement that you wish to opt out.

15.7 Governing Law. These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.8 Venue. Subject to the arbitration provisions, any action permitted in court shall be brought exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.


16. Termination

16.1 Termination by You. You may terminate these Terms at any time by deleting your account and discontinuing use of the Service. Cancellation of any subscription must be done through your Apple or Google account settings.

16.2 Termination by Voyage. We may suspend or terminate your access to the Service, with or without notice, for any reason or no reason, including but not limited to violation of these Terms.

17.1 Apple App Store. If you downloaded the Service from the Apple App Store, the following additional terms apply:

17.2 Google Play. If you downloaded the Service from Google Play, you agree to comply with Google's terms and policies. Google has no obligation to provide support and is not responsible for the Service.


18. Export Controls and Sanctions

You agree to comply with all applicable export and re-export control laws and regulations, including the U.S. Export Administration Regulations and trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control. You represent that you are not located in any embargoed country and are not on any prohibited or restricted party list.


19. Modifications to These Terms

19.1 Right to Modify. We may modify these Terms at any time at our sole discretion. We will indicate the "Last Updated" date at the top of these Terms and may provide additional notice for material changes (e.g., in-app notification or email).

19.2 Continued Use. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modifications, you must stop using the Service and may terminate your account.


20. General Provisions

20.1 Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Voyage regarding the Service and supersede all prior agreements and understandings.

20.2 Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20.3 No Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

20.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.

20.5 No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Voyage.

20.6 Force Majeure. We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

20.7 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

20.8 Language. These Terms are written in English. Any translation is provided for convenience only, and the English version shall prevail in case of conflict.

20.9 Electronic Communications. You consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.


21. California Residents

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights are described in our Privacy Policy. Under California Civil Code § 1789.3, California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
